Bunlar;<\/p>\n<ul>\n<li>\u0130\u015f\u00e7inin k\u0131dem tazminat\u0131 alabilmesi i\u00e7in bir i\u015fverene veya bir i\u015fyerine ba\u011fl\u0131 olarak en az bir y\u0131l \u00e7al\u0131\u015fmas\u0131 gerekmekte olup, kanun koyucu bu s\u00fcreyi k\u0131dem s\u00fcresinin belirlenmesinde bir \u00f6l\u00e7\u00fct olarak getirmi\u015ftir.<\/li>\n<li>\u0130\u015f\u00e7inin k\u0131dem tazminat\u0131 alabilmesi i\u00e7in i\u015f\u00e7i olarak \u00e7al\u0131\u015fmas\u0131 yeterli olmay\u0131p, bu \u00e7al\u0131\u015fman\u0131n ayn\u0131 zamanda i\u015f s\u00f6zle\u015fmesine dayanmas\u0131 gerekmektedir.<\/li>\n<li>K\u0131dem tazminat\u0131 i\u015f s\u00f6zle\u015fmesinin sona erdi\u011fi t\u00fcm hallerde talep edilemez. Kanunda i\u015f\u00e7iye k\u0131dem tazminat\u0131na hak kazand\u0131ran sebeplerden birisi i\u015f s\u00f6zle\u015fmesinin kanundaki sebeplere dayal\u0131 olarak feshedilmesi, di\u011feri de i\u015f\u00e7inin \u00f6l\u00fcm\u00fcd\u00fcr.<\/li>\n<li>\u0130\u015fverenin, 4857 say\u0131l\u0131 \u0130\u015f Kanunu\u2019nun 25\/II-2\u2019de belirtilen \u2018Ahlak ve iyiniyet kurallar\u0131na uymayan haller ve benzerleri\u2019nde belirtilen sebeplerden birisine dayanan fesihlerden ba\u015fka yapt\u0131\u011f\u0131 fesihler, hakl\u0131 veya haks\u0131z, iyiniyetli veya k\u00f6t\u00fcniyetli, ge\u00e7erli veya ge\u00e7ersiz, ihbarl\u0131 veya ihbars\u0131z t\u00fcm fesihler i\u015f\u00e7iye k\u0131dem tazminat\u0131 \u00f6denmesini gerektirir.<\/li>\n<li>\u0130\u015f\u00e7i, 4857 say\u0131l\u0131 \u0130\u015f Kanunu\u2019nun 24. Maddesinde belirtilen hakl\u0131 sebeplerden birine istinaden i\u015f s\u00f6zle\u015fmesini ihbars\u0131z olarak sona erdirmesi halinde i\u015f\u00e7i k\u0131dem tazminat\u0131na hak kazanacakt\u0131r.<\/li>\n<li>Erkek i\u015f\u00e7inin askere gitmesi, kad\u0131n i\u015f\u00e7inin evlenmesi, i\u015f\u00e7inin \u00f6l\u00fcm\u00fc, emeklilik, ya\u015fl\u0131l\u0131k, malull\u00fck ayl\u0131\u011f\u0131 veya toptan \u00f6deme almak amac\u0131yla i\u015f s\u00f6zle\u015fmesinin feshedilmesi hallerinde de i\u015f\u00e7i, k\u0131dem tazminat\u0131na hak kazanacakt\u0131r.<strong style=\"font-style: inherit; color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; text-align: var(--text-align); letter-spacing: 0.01em;\">&nbsp;<\/strong><\/li><\/ul>\n<ol>\n<li><strong>K\u0131dem Tazminat\u0131 Hesaplamas\u0131 Nas\u0131l Yap\u0131lmaktad\u0131r?<\/strong><strong style=\"font-style: inherit; color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; text-align: var(--text-align); letter-spacing: 0.01em;\">&nbsp;<\/strong><\/li><\/ol>\n<p>\u0130\u015f\u00e7inin i\u015fe ba\u015flad\u0131\u011f\u0131 tarihten itibaren hizmet akdinin devam\u0131 s\u00fcresince her ge\u00e7en tam y\u0131l i\u00e7in i\u015fverence i\u015f\u00e7iye otuz g\u00fcnl\u00fck \u00fccreti tutar\u0131nda 1475 say\u0131l\u0131 kanunun 14\/1. Maddesi gere\u011fince k\u0131dem tazminat\u0131 \u00f6denir. Bir y\u0131ldan artan s\u00fcreler i\u00e7in de ayn\u0131 oran \u00fczerinden \u00f6deme yap\u0131l\u0131r. Kanun metni incelendi\u011finde i\u015f\u00e7iye \u00f6denecek k\u0131dem tazminat\u0131n\u0131n hesaplanmas\u0131 i\u00e7in, \u00f6nce i\u015f\u00e7inin bir g\u00fcnl\u00fck \u00fccreti tespit edilecek, tespit edilen bu \u00fccret \u00f6nce otuzla, daha sonra da i\u015f\u00e7inin \u00e7al\u0131\u015ft\u0131\u011f\u0131 y\u0131l ile \u00e7arp\u0131lacak, bir y\u0131ldan artan s\u00fcreler i\u00e7in de hesaplama yap\u0131larak \u00f6deme yap\u0131lacakt\u0131r.<\/p>\n<p><\/p>\n<ol>\n<li><strong>Ya\u015f \u015eart\u0131 Hari\u00e7 Emeklili\u011fe Hak Kazan\u0131lmas\u0131 Durumunda \u0130stifa Edilirse K\u0131dem Tazminat\u0131 Al\u0131nabilir mi?<\/strong><strong style=\"font-style: inherit; color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; text-align: var(--text-align); letter-spacing: 0.01em;\">&nbsp;<\/strong><\/li><\/ol>\n<p>Ya\u015f \u015fart\u0131 hari\u00e7 emeklili\u011fe hak kazan\u0131lmas\u0131 durumunda istifa edilirse k\u0131dem tazminat\u0131 al\u0131nmas\u0131 baz\u0131 \u015fartlar\u0131n varl\u0131\u011f\u0131 halinde m\u00fcmk\u00fcn olmaktad\u0131r. Bunlar;<\/p>\n<ul>\n<li>Son i\u015fyerinde en az 1 y\u0131l \u00e7al\u0131\u015fmak,<\/li>\n<li>09.1999 tarihinden \u00f6nce ilk sigortal\u0131l\u0131\u011f\u0131 bulunan \u00e7al\u0131\u015fanlar i\u00e7in 15 y\u0131l sigortal\u0131l\u0131k \u015fart\u0131 ve 3600 prim g\u00fcn sigortal\u0131k s\u00fcresi olmak,<\/li>\n<li>09.1999 tarihi ile 30.04.2008 tarihleri aras\u0131nda ilk sigortal\u0131l\u0131\u011f\u0131 olan \u00e7al\u0131\u015fanlar i\u00e7in, sigortal\u0131l\u0131k s\u00fcresi g\u00f6z \u00f6n\u00fcnde bulundurulmaks\u0131z\u0131n 7000 prim \u00f6deme g\u00fcn say\u0131s\u0131 veya \u201c4500 prim g\u00fcn\u00fc ve 25 y\u0131l sigortal\u0131l\u0131k s\u00fcresi olmak,<\/li>\n<li>04.2008 tarihi ile 31.12.2008 tarihleri aras\u0131nda ilk sigortal\u0131l\u0131\u011f\u0131 olan \u00e7al\u0131\u015fanlar i\u00e7in 4600 prim g\u00fcn sigortal\u0131l\u0131k s\u00fcresi olmak,<\/li>\n<li>01.2009 tarihi ile 31.12.2015 tarihleri aras\u0131nda ilk sigortal\u0131l\u0131\u011f\u0131 olan \u00e7al\u0131\u015fanlar i\u00e7in 4600-5300 prim g\u00fcn (her y\u0131l i\u00e7in 100 g\u00fcn eklenerek hesaplan\u0131yor) sigortal\u0131l\u0131k s\u00fcresi olmak,<\/li>\n<li>01.2016 tarihinden sonra ilk sigortal\u0131l\u0131\u011f\u0131 bulunan \u00e7al\u0131\u015fanlar i\u00e7in 5400 prim g\u00fcn sigortal\u0131l\u0131k s\u00fcresi olmak, \u015eartlar\u0131 sa\u011fland\u0131\u011f\u0131nda \u201cSGK\u2019dan k\u0131dem tazminat\u0131na esas yaz\u0131\u201d al\u0131narak i\u015ften ayr\u0131lmak m\u00fcmk\u00fcnd\u00fcr.<a href=\"#_ftn3\" name=\"_ftnref3\">[3]<\/a><\/li>\n<\/ul>\n<p>Burada \u00f6nemle belirtmek gerekir ki, s\u00f6z konusu \u2018k\u0131dem tazminat\u0131 esas yaz\u0131n\u0131n\u2019, istifa edilmeden \u00f6nce al\u0131nmas\u0131 gerekmektedir. Aksi halde yani bu k\u0131dem tazminat\u0131 esas yaz\u0131s\u0131 al\u0131nmadan istifa edilmesi halinde, k\u0131dem tazminat\u0131n\u0131n al\u0131nmas\u0131 m\u00fcmk\u00fcn olmayacakt\u0131r.<strong style=\"font-style: inherit; color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; text-align: var(--text-align); letter-spacing: 0.01em;\">&nbsp;<\/strong><\/p>\n<ol>\n<li><strong>Sonu\u00e7<\/strong><strong style=\"font-style: inherit; color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; text-align: var(--text-align); letter-spacing: 0.01em;\">&nbsp;<\/strong><\/li><\/ol>\n<p>Sonu\u00e7 olarak, k\u0131dem tazminat\u0131na hak kazanabilmesi i\u00e7in belirli \u015fartlar mevcuttur. Bu \u015fartlar sa\u011flanmadan i\u015f\u00e7i taraf\u0131ndan istifa edilmesi durumunda k\u0131dem tazminat\u0131 hak kazan\u0131lmas\u0131 da m\u00fcmk\u00fcn olmayacakt\u0131r. Durum bu olmakla birlikte baz\u0131 hallerde i\u015f\u00e7i hakl\u0131 olsa ve k\u0131dem tazminat\u0131na hak kazansa dahi i\u015fvereni taraf\u0131ndan i\u015f\u00e7iye k\u0131dem tazminat\u0131 \u00f6demesi yap\u0131lmamaktad\u0131r.
